These Terms of Service (“Terms”) govern your use of the website at cbd.restaurant (the “Site”), our products, and our SMS messaging program (collectively, the “Services”), all operated by Life Candles LLC d/b/a CBD Restaurant (“we,” “us,” “our”). By accessing or using the Services, you agree to be bound by these Terms.

1 · Eligibility

You must be at least twenty-one (21) years of age and reside in a U.S. state or jurisdiction where the purchase of hemp-derived CBD products is legal. By using the Services, you represent and warrant that you meet these requirements.

2 · Products

CBD Restaurant sells hemp and hemp-derived products containing less than 0.3% delta-9 tetrahydrocannabinol (THC) by dry weight, as defined in the Agricultural Improvement Act of 2018. Product descriptions, prices, and availability are subject to change without notice.

3 · Orders, payment, and pricing

By placing an order you agree to pay the listed price plus applicable taxes and shipping fees. We reserve the right to refuse, cancel, or limit any order at our discretion (for example, due to suspected fraud, product unavailability, or shipping restrictions in your jurisdiction). Charges are processed through a PCI-compliant payment processor at the time of order.

6 · SMS messaging

Our SMS messaging program is governed by our SMS Terms and Privacy Policy. By opting in (verbally and then confirming via SMS reply, or by submitting an opt-in form), you authorize CBD Restaurant to send recurring automated marketing and transactional messages. Reply STOP to unsubscribe.

7 · Acceptable use

You agree not to: (a) misrepresent your age or identity, (b) use the Services to violate any law or third-party right, (c) attempt to interfere with or compromise the Services or our infrastructure, (d) scrape, copy, or republish our content without permission, or (e) use the Services to harass or harm any person.

8 · Intellectual property

All content on the Site — including text, images, logos, product descriptions, and software — is owned by CBD Restaurant or our licensors and is protected by U.S. and international intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

9 · Disclaimers

The Services are provided as is and as available, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or completely secure.

10 · Limitation of liability

To the maximum extent permitted by law, CBD Restaurant and Life Candles LLC shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to your use of the Services. Our aggregate liability for any claim arising from the Services shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11 · Indemnification

You agree to indemnify and hold harmless CBD Restaurant, Life Candles LLC, and our officers, employees, and agents from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising from your breach of these Terms or your misuse of the Services.

12 · Governing law and arbitration

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any dispute arising from these Terms or the Services shall be resolved through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, with the seat of arbitration in Los Angeles County, California. You waive any right to a jury trial or to participate in a class action. Either party may seek injunctive relief in court for intellectual property or unauthorized-access claims.

We may update these Terms from time to time. Material changes will be posted on this page with an updated Last Updated date. Continued use of the Services after a change constitutes acceptance of the revised Terms.
